Overview

Counsel to the firm, after four decades of practicing law, Robert J. Clayton now concentrates his practice on first party property insurance coverage disputes and litigation.  He has had the honour of representing Insurers in Builder’s Risk/Wrap Up policy interpretations and disputes; construction and design defects claims and their exclusions under different policy wordings including LEG and DE.  He remains actively involved in subrogation and casualty defence on behalf of his clients and has had carriage of each step in the litigation process from investigation and claims handling to alternative dispute resolution, full litigation, trial and appeal.  He continues to represent clients in professional liability claims and has represented victims of personal injury in achieving fair and reasonable compensation for them.

His experience has earned him a Peer Reviewed Distinguished Rating from Martindale-Hubbell, a continuing achievement to the present.

Robert holds a Certificate of Achievement in Advanced ADR and is available to conduct mediations.

When not practicing law, you can find him at the rink playing hockey, once a vocation which earned him three inductions into his hometown, Midland Sports Hall of Fame.

Publications & Presentations

Robert has been a course instructor in Civil Litigation for the Bar Admission Course for the Law Society of Upper Canada.  As section leader, he overhauled the practice skills course in Advocacy.  He has chaired and lectured on continuing legal education programs for the Law Society of Upper Canada and the Canadian Bar Association.  He has contributed articles to the Continuing Legal Education Series on Trial Advocacy and the conduct of personal injury actions from the Institution of Proceedings to trial decision. Robert regularly provides advice and opinions to his clients on some of the largest construction projects in Canada and has been a speaker on insurance matters put on by Ontario and National associations.
